General information
     
 

We provide consulting and coaching services in accordance with these General Terms and Conditions (GTC). These terms and conditions are deemed to be accepted by the client (hereinafter also referred to as the client) upon commissioning. Further agreements are only binding for us if they are confirmed by us in writing. The contracts concluded by us are service contracts, unless expressly agreed otherwise. The object of the contract is therefore the provision of the agreed services, not the achievement of a specific result. In particular, we do not owe a specific economic result. Your opinions and recommendations prepare the client's decision. Under no circumstances can they replace them. The use of our services does not replace a visit to a doctor, psychotherapist or alternative practitioner. The patient will continuously check for himself whether treatment by another specialist is necessary. The patient further assures that he/she has undergone an adequate examination beforehand. Each patient confirms that he/she is using the services of his/her own free will and accepts full responsibility for him/herself and his/her health. Each patient decides for him/herself to what extent he/she will engage in the processes of self-awareness, self-healing and change. We do not accept any responsibility for this.

 
     
When using our methods, we do not make any promises of healing and do not administer any medication. Our work is carried out without any obligation to bring about any treatment or healing success.
     
We provide our consulting services on the basis of the data and information provided to us by the client or its agents. These are checked for plausibility by the client.
     
     
Offers, fees
     
 

The offers are subject to change. Subject to change without notice. All fees are in euros. For coaching and consulting services, the fees specified under "Fees" will be charged. Additional costs, such as telephone charges, travel and accommodation costs, etc., will be charged separately to the client or customer within reasonable limits after consultation.

 
     

Appointments for telephone coaching are agreed between the coach and client according to mutual availability. As long as there is no confirmation of costs from another source, the client is deemed to be the debtor of the coaching or consulting fee.

     

Unless otherwise agreed, the fee is due immediately after invoicing and without deduction. Retention of the fee and offsetting are only permitted if the client's claims are recognized by us or have been legally established.

     
     
Cancellation of an appointment
     

Agreed appointments are always binding. This also applies to the free preliminary meeting. The time and place of the coaching session are mutually agreed by the coaching partners. The client undertakes to be punctual for all sessions.

     

Coaching sessions can be canceled or rescheduled free of charge up to one working day before the appointment at the latest. After that, the fee will be charged at 100%. In the event of a no-show, the full fee is due as a cancellation fee.

     
     
Force majeure and other performance obstacles
     

We are entitled to postpone the agreed coaching dates in the event of force majeure, including impediments to performance due to illness, accident or similar.

     

In this case, the coach will inform the client as soon as possible and offer an alternative appointment. If the client could not be reached at the telephone number left and in any other case, there is no entitlement to reimbursement of travel or other costs.

     
     
Copyright
     

Unless otherwise agreed, all documents handed over to the client are included in the agreed remuneration. The documents are intended for the personal use of the client.

     

The copyright to the coaching concepts and documents belongs solely to us. The client is not permitted to reproduce the documents in whole or in part and/or make them accessible to third parties without our written consent. Publication, even in part, is prohibited.

     
     
Insurance cover
     

Each client bears full responsibility for themselves and their actions inside and outside the coaching sessions and is liable for any damage caused. Coaching is not psychotherapy and cannot replace it. Participation requires normal mental and physical resilience.

     

The organizer of team coaching sessions, seminars, workshops etc. is always the client. The participants therefore have no insurance cover from us.

     
     
Liability
     

The information and advice in coaching sessions and in all documentation is carefully considered and checked by the coach. Our activity is purely a service activity.

     

Success is therefore not owed. Liability is excluded. The dispatch or electronic transmission of any data is at the risk of the client.

     
     
Confidentiality
     
We undertake to maintain confidentiality vis-à-vis third parties about all operational, business and private matters of the client that become known in the course of our work, even after the termination of the contract.
     
In addition, we undertake to store the documents provided for the purpose of the consultancy work carefully and to protect them against access by third parties.
     
     
Obligation of the client to cooperate
     

Coaching takes place on the basis of the preparatory discussions held between the parties. It is based on cooperation and mutual trust. In this context, we would like to point out that coaching is a free, active and self-responsible process and that certain successes cannot be guaranteed. We assist the client as a process facilitator and as support for decisions and changes - the actual change work is done by the client. The client should therefore be willing and open to dealing with themselves and their situation.

     
     
Differentiation from psychotherapy
     
Coaching is not therapy and does not replace it. Coaching is based on a coach-client relationship that is characterized by partnership and clearly distinguishes the role of the coach from that of therapists and doctors.
     
Psychotherapy is problem and symptom-oriented, it deals with the past and endeavors to heal old wounds. Coaching is solution-oriented and focused on the present, future and activity. Psychotherapy is the targeted treatment of a mental illness. Coaching serves people who are capable of action and self-reflection.
     
The result of coaching is not the alleviation of psychological complaints, but the individual development of the client, which is accompanied by an increase in their general quality of life.
     
     
Final provision
     
Should individual provisions of the contract with the client, including these General Terms and Conditions, be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The wholly or partially invalid provision shall be replaced by a provision whose economic success comes as close as possible to that of the invalid provision.
     
     
Place of fulfillment and jurisdiction
     
The place of performance is Münster. The place of jurisdiction is the competent local court in Münster.
     
The law of the Federal Republic of Germany shall apply.
     
 

 

   
     
Supplement: General terms and conditions for seminars
     
  § 1 Application  
     

Application for events (seminars) must be made either via the homepage (contact form) or by email. The number of participants in the events is limited and will be announced at the time of registration.

     
     
§ 2 Event services and prices
     

The amount of the event prices and the underlying services will be announced when registering for the event or can be found in the event description for the respective event or on the homepage.

     
     
§ 3 Terms of participation
     

Cell phones must be switched off or in flight mode in the event rooms. If a participant disrupts an event through his/her appearance or behavior, or if a participant repeatedly fails to comply with the instructions of the event manager necessary for the smooth running of the event, he/she may be excluded from the event. In this case, the event fee must be paid in full.

     
     
§ 4 Illness, pregnancy, death in the family and other impediments
     

In one of the above cases, we will grant the participant the opportunity to attend the same or a similar event that could not be attended due to the inability to attend within 12 months.

     
     
§ 5 Payment
     

Payment of the event fee shall be made exclusively in accordance with the agreed conditions. The fee for the events listed under §2 is due upon registration. The event fee includes the event, teaching materials and information letters. Travel, accommodation and lunch are organized and paid for by the participant.

     
     
§ 6 Termination / Cancellation
     

In the event that you terminate the contractual relationship without good cause on your part, the following regulation applies: If you cancel (terminate) your registration up to four weeks before the start of the event, we will refund the full event price. From 30 days before the start of the event, we must charge the full amount. In the course of a seminar, the seminar fee cannot be refunded if participation is discontinued at the participant's own request.

     
     
§ 7 Repayment
     
If an announced event does not take place, we will refund all amounts received by us immediately after notification, unless we are unable to hold the event due to illness of yourself or a family member or in the event of death. No further liability or compensation claims can be asserted against us as the organizer if an event does not take place. In principle, we have the right to cancel events without substitution.
     
     
§ 8 Instructional material
     
The accompanying material handed out at an event is subject to our copyright and may not be passed on to third parties or reproduced in any way. Video and audio recordings are not permitted unless permission is obtained from the organizer.
     
     
§ 9 Ownership and property rights
     
We hope that the value of the knowledge we impart and the therapeutic methods and training concepts we have developed will be appreciated: We therefore recommend that our participants only train themselves in the techniques and methods taught in our training courses or pass them on themselves or through others as part of training courses or seminars once the content and techniques have been appropriately internalized.
     
     
§ 10 Personal responsibility / insurance
     
  Each participant is fully responsible for his/her own actions. Insurance is the responsibility of the participant. Any liability claims against us are excluded. This applies in particular to bodily injury and theft of any kind. The organizers must be informed of any illnesses before the start of the event. In serious cases, they may make participation impossible. It is an absolute prerequisite that the participant is physically and mentally healthy and does not consume drugs. Our offers are expressly not intended as therapy or as a substitute for therapy. Due to drug use, someone can be immediately excluded from the training, course or seminar by the organizer and has no right to a refund.
